"mawhiba-rabit" Terms of Use Agreement
This agreement ("Terms") sets forth the terms and conditions of use for all services provided under the name "mawhiba-rabit" (the "Service"). The Service is provided in accordance with the laws of the Kingdom of Saudi Arabia and the principles of Islamic law. Each user of the Service ("User") agrees to these Terms by using the Service.
Article 1: Approval of Terms
- Users must use the Service in accordance with these Terms. Users may not use the Service unless they expressly and irrevocably agree to these Terms.
- If you are a minor, you must obtain the consent of your parent or legal guardian to use the Service.
- The User's actual use of the Service constitutes the User's express and irrevocable agreement to these Terms, and these Terms become effective for the User from the time of agreement.
Article 2: Definitions In these Terms, the following terms shall have the meanings specified below:
- "Sharing the Review": A service that allows users to create and publish their experiences with products based on their actual use, in the places and ways we define within the Service.
- "Content": Refers to text, music, images, videos, programs, code, and other information.
- "Service Content": Content that can be accessed through this service.
- "User-generated content": Content that a user posts, submits, or uploads to be stored on our servers.
- "Public user-generated content": User-generated content that is generally available for viewing and access by other users.
Article 3: Handling Information
- When providing personal information to us in connection with the use of the Service, users must provide true, accurate and complete information.
- The handling of users' personal information is governed by our Privacy Policy, which complies with the Personal Data Protection Law (PDPL) and relevant legislation in the Kingdom of Saudi Arabia.
Article 4: Registered Users
- Registration procedure: A user can become a registered user by completing the account registration procedure specified by us.
- Enrollment Information Management: Registered users are responsible for maintaining the confidentiality of their account information and passwords and may not allow any third party to use them. We do not accept any liability for any loss arising from inadequate management, except where caused by our fault.
- Withdrawal: Registered users can withdraw from the Service at any time by following the specified procedures. Upon withdrawal, the user loses all rights related to the use of the service.
- Stopping use or canceling registration: We reserve the right to take measures such as suspending the use or canceling the registration of any registered user without prior notice if we determine that they have violated or are at risk of violating these Terms.
Article 5: Prohibited Acts Users must not perform the following actions that contravene the laws of Saudi Arabia, the principles of Islamic law, public order and decency:
- Religious and political prohibitions:
- Insult, disparage, or criticize Islam, Allah (SWT), the Prophet Muhammad (PBUH), or any other religious symbols.
- Criticize, denigrate, or insult the Custodian of the Two Holy Mosques, the royal family, the government, or public institutions in Saudi Arabia.
- Spreading information or rumors that threaten national security, unity, or stability.
- Promote, support, or justify terrorism, extremist ideology, or sectarian conflict.
- Prohibitions related to public order and decency:
- Posting or sending pornography, obscene content, photos or videos containing excessive nudity, or any other content that violates public morals.
- Promoting alcohol, pork, gambling, usury, or anything else prohibited by Islamic law.
- Encouraging or suggesting inappropriate relationships between unmarried men and women.
- Promoting magic, fortune-telling, or other non-Islamic superstitions.
- Violation of rights and illegal acts:
- Violate intellectual property rights such as copyrights, trademarks, privacy rights, rights of reputation, or any other rights of ours or any third party.
- Any act that violates Saudi Arabia's Cybercrime Law (such as unauthorized access to computer systems, theft of personal data, publishing defamatory information).
- Impersonating others or intentionally spreading false information.
- Fraud, threats, harassment, or any other act that causes harm or inconvenience to others.
- Sending or writing malicious computer programs.
- Miscellaneous:
- Use the Service for commercial purposes without our prior approval.
- Impede the operation of the service or damage its reputation.
- Aiding or abetting any of the above-mentioned acts.
- Any other actions we deem inappropriate.
Article 6: Intellectual Property Rights and Use of Content
- The copyright in User-Submitted Content belongs to the user who created it. However, by posting Content on the Service, the User grants us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use such Content for the purposes of providing, promoting and advertising the Service.
- The User represents and warrants that the Content provided by the User does not infringe the rights of any third party and complies with all applicable laws of the Kingdom of Saudi Arabia.
- We reserve the right to monitor User-Submitted Content for compliance with the law and these Terms. We have the right to remove or not post any User-Submitted Content without prior notice if we determine that it violates these Terms.
Article 7: Dealing with Content
- We may receive a portion of the revenue when users purchase products featured in the content.
- We do not guarantee the accuracy, completeness or currency of the information posted on the Service (including prices and product descriptions). Users should verify the final information on the respective sales websites at their own risk.
- We do not assume any liability for any damage caused to the user or any third party due to user-submitted content. All responsibility for user-submitted content rests with the user who posted it.
Article 8: Compensation If we incur any damages (including attorneys' fees) due to User's violation of the law or these Terms, User shall promptly reimburse us upon our request.
Article 9: Provision of Service, Disclaimer of Warranties, Change, and Termination
- We may modify all or part of the content of the Service or discontinue providing the Service at any time.
- We do not warrant that the Service will be provided without interruption, or that it is free of errors or security defects.
Article 10: Disclaimer We assume no liability for any damage to the User arising from the use of the Service, except in cases of gross negligence or willful misconduct on our part. Even if our liability is recognized, compensation is limited to the direct and ordinary damages incurred by the user.
Article 11: Methods of notice or communication Notices or communications from us will be sent to users by posting in an appropriate place on the Website or in any other manner we deem appropriate.
Article 12: Modification of Terms We reserve the right to modify these Terms at any time without notice to Users if we deem it necessary. The amended Terms will become effective from the time they are posted on the Service, and the user's continued use of the Service following the amendment will be deemed to be acceptance of the amended Terms.
Article 13: Governing Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.
- Any dispute arising out of or relating to the Service between the User and us shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Saudi Arabia.
Article 14: Severability If any provision of these Terms is held invalid, the remaining provisions remain in full force and effect.
Article 15: Amicable settlement In the event of any matters not addressed in these Terms or any doubt as to their interpretation, the parties agree to consult in good faith to reach a prompt resolution.
